‘Shy’ driver fired over drug test; files lawsuit

A former driver for a Wisconsin-based carrier has filed suit against the company in state court, claiming that he was illegally fired for allegedly refusing to take a drug test.

Paul O. Taylor, the attorney representing the driver, said that the man in fact had agreed to the drug test, but suffers from Paruresis – also known as shy bladder syndrome – and was unable to produce the amount of urine required for the test.

Marshfield Clinic – the place that did the testing and which is also named in the lawsuit – notified the carrier, Push Inc. of Rice Lake, WI, which, in turn, fired the driver several days later.

Taylor said Push did not obtain confirmation of the test from the medical review officer, which is required by federal controlled substance testing regulations.

In addition, the lawsuit charges that Push made it difficult for the driver to find another job, telling at least one carrier with whom he had applied that the driver refused to take a drug test.

Taylor said this kind of thing is not unusual in an industry where trucking companies are looking for ways to cut corners, including using inexpensive clinics for drug tests.

“You get what you pay for,” he said. “Drivers are at the mercy of these clinics.”

Taylor said he is hopeful that cases like this will send a message out to trucking companies regarding drug testing.

“We’ve gone mad with the whole drug testing thing,” he said. “There’s got to be some protection (for drivers) against trucking companies from abusing the whole drug testing process.”

I can never see the logic in drug tests.
If you can trust the person, why the hell did you hire them anyways!?

This guy has every right to sue, and I hope he wins. Not only is drug testing an invasion in privacy, but I think its demeaning to employees.

I never minded taking drug tests for any of the dealerships I worked for. I also had to take drug tests when I worked for American Honda at the Civic factory in Ohio, for two of the five couriers I've driven for, and for one of the four cab companies I've driven for. But if I went in and couldn't produce, and got fired, or not hired, based solely on that, I'd be mighty ticked off. If anything else I would tell the clinic I will be back, then I'd pop into Kroger and pick up a half gallon of apple juice, chug it over the course of the next hour, and waddle back into the clinic asking for the cup.

Here are some scary numbers - In a top 20 city (population), I would run a help wanted ad for salespeople. We had a drug test for all new hires. Almost 90% of the applicants who accepted an offer for work, disappeared between my office and the drug test lab.

We offered strong benefits, great pay, and perhaps, the strongest bonus opportunities in the city.

They just couldn't pass the test.

Apart from unskilled managers (people who were advanced beyond their training and ability), this has been the biggest problem for the retail business for years now.

I'm a strong proponent of drug testing. I've had some real good salespeople who were also crack-heads, but that was back in then 80's when they had some sense of right and wrong...they didn't steal to support their habit...they sold cars.


Today's druggies will steal in a heart beat.

Taking drugs is wrong FULL STOP.
If a driver has nothing to hide, they won't refuse a drug test.

I feel innocent people should have the right to live, and not be afraid of being killed in a motor vehicle accident where drugged out truck drivers are involved. If a person can't carry out his or her work duties without the use of an illegal substance, then it's time they think about not working!
Personally I'd like to see drug testing for all drivers.

Good point but you have to think from other point of view too. What if someone saw him taking drugs? In this days we can find many drug rehab program (http://www.drugrehab.net/LF_drug%20rehab.php). It's better to prevent some things before they will harm someone.
